Either you or your employer can end an employment relationship by terminating the contract of service. Find out the guidelines for termination with or without notice and termination due to misconduct including appeal against wrongful dismissal.

What is termination

When either you or your employer wants to end the employment relationship, you do so by terminating the contract of service. Termination can be with or without notice, or caused by employee misconduct.

Termination with notice

If your contract specifies a notice period, you must either serve the notice when you resign or pay compensation in lieu of notice. Notice can be waived by mutual consent between you and your employer.

Termination without notice

If you resign without giving notice, you need to pay salary in lieu of notice. Termination without notice can happen in situations such as breaking the terms of the contract, failure to pay salary and absence without cause.

Termination due to employee misconduct

Termination due to misconduct is a serious disciplinary action that should be carefully considered. Employers must conduct a formal inquiry before taking any disciplinary action.

Appeal against wrongful dismissal

If you feel you have been wrongfully dismissed by your employer, you may appeal to the Minister for Manpower to be reinstated in your former job.
